Former Brazilian President Receives Prison Sentence
A total of four out of five magistrates on the court’s panel supported a conviction on all five counts in this landmark ruling.
The ruling was finalized when Justices Carmen Lucia and Cristiano Zanin cast their votes declaring Bolsonaro guilty of conspiring to stage a coup in an effort to stay in office after his 2022 election loss. Their support formed a 4-1 majority alongside fellow justices Alexandre de Moraes and Flavio Dino, who had already voted to convict earlier in the week.
The lone opposing vote came from Justice Luiz Fux, who on Wednesday argued for Bolsonaro’s acquittal.
Bolsonaro was found guilty of attempting a coup d'état, being part of an armed criminal alliance, trying to dismantle Brazil’s democratic system through violence, committing acts of aggression against state institutions, and vandalizing safeguarded government property during the January 8, 2023 attack on official buildings by his followers.
As per the prosecutors, the coup scheme involved plotting the assassination of President Luiz Inacio Lula da Silva, Vice President Geraldo Alckmin, and Supreme Court Justice Alexandre de Moraes using explosives, firearms, or toxins.
Justice Carmen Lucia stated that the prosecution presented "conclusive evidence" demonstrating that the organization, directed by Bolsonaro, had enacted a "progressive and systematic plan to attack democratic institutions."
